The Idaho Shade Rule
The Idaho Department of Lands (IDL) has a rule which prohibits private forestland owners from harvesting trees on their own land within 75 feet on each side of a fish-bearing stream. The rule is supposed to ensure that there is adequate shade for the stream to keep the water cool for fish. This, however, unconstitutionally restricts private property rights, and it directly takes money out of the owner’s pocket by prohibiting them from harvesting their own trees.
Please share your opinion with the House and Senate Resource Committees on why the rule should not be required on private property unless compensation is provided.
